The incident happened on Trainwrecks' Scuffed Podcast when he began to distribute 💦cash to subscribers via his sponsors Cash App. A clip of the podcast over on Reddit shows Trainwreckstv under the Just Chatting category with the title SUBONLY GIVE AWAY.

It shows him appearing to run what is basically an illegal sweepstake event. The guests on his podcast, including Tfue, xQc, and MaဣnuelFerraraTV shout out numbers before Trainwrecks declares "LosPollos and Nickmercs, $45k to the chat!"

Hosting competitions for subs only is not only against Twitch's TOS but als🔜o against the law. This is because sub only giveaways are considered to be lotteri⛎es as entry is blocked by a paywall, in this case, the cost of a subscription, and as such falls under strict legislation.

These rules are set out by the and clearly state "Sweepstakes-type promotions that require a purchase by partici🐬pants are illegal in the United States."

In re♚lation to Twiಞtch directly, their states: "Users may promote, administer, or conduct a promotion (e.g., a contest or sweepstakes) on, through, or utilizing the Twitch Services (a “Promotion”)."

However, it isn't quite that simple as creators are respo♈nsible for ensuring any giveaways follow all applicable laws. This is evident in the next section which continues: "If you choose to promote, administer, or conduct a Promotion, you must adhere to the following rules: (1) You may carry out Promotions to the extent permitted by applicable law and you are solely responsible for ensuring that any Promotions comply with any and all applicable laws, obligations, and restrictions"

Twitch's TOS also contain specific ▨sections relating to illegal activity including "YOU AGREE NOT TO violate any law... and will not use the Twitch Services for any illegal pur♚pose, or in violation of any local, state, national, or international law or regulation, including without limitation laws governing intellectual property and other proprietary rights, data protection, and privacy."

This basically means that sub only giveaways are not permitted, nor are raffles or any othᩚᩚᩚᩚᩚᩚ⁤⁤⁤⁤ᩚ⁤⁤⁤⁤ᩚ⁤⁤⁤⁤ᩚ𒀱ᩚᩚᩚer competitions that require a viewer to pay for an entry🍎. In the past, Twitch users have been banned and even lost their partnership for doing similar and often much smaller giveaways.

Giveaway rules have long been a source of discussion in the streaming community, so it's not unreasonable to assume someone with a large channel and a long streaming history would be aware of the issues. As to if Tr😼ainwrecks and his guests knew the illegal status of the giveaway?
